Scope and Content

Collection consists of the territorial and New Mexico District Court records for Valencia County, New Mexico (1849-1953). The bulk of the material covers the years 1849-1921. Included are record books (1851-1916), case files (1851-1953), and other court material. Record books consist of various dockets (1851-1913), court proceedings record books (1854-1856, 1859-1860, 1889-1909, 1873-1880), a record book of invoices (1865-1873), a roll book of attorneys at law (1874-1899), minutes (1903), jury book (1905-1910, 1923) and a cash book (1865-1873). Docket include civil (1882-1912), judge's (1910-1913), cost (1878-1881, 1888-1916) and minutes and motions (1851-1854) volumes. Judges' dockets cover criminal (1910-1913) and civil (1910-1911) trials. Case files consist of criminal cases 1-836, 1646 (1852-1912, 1931) and civil cases 2-4302 (1851-1940). Civil cases include tax cases with two numbering systems: cases 1785-6407 (1912-1952) and cases 1-602 (1926-1952). Large gaps may exist between case files. Other court materials consist of jury records and court material. Additional material for Valencia County can be found in the Bernalillo County District Court records.

Historical Note:

With the occupation of New Mexico in 1846 by the United States, seven political subdivision established by Mexico in 1844 were recognized as counties under the Kearny Code of Laws. Valencia County was one of these seven original counties. New Mexico remained under a military form of government until September 9, 1850, when an act of Congress established the Territory of New Mexico. On January 9, 1852, the boundaries of the counties were fixed by an act of the Territorial Legislative Assembly. Valencia County, New Mexico was created in 1852. Valencia County, New Mexico was placed in the 3rd Judicial District of the United States Territorial Courts in New Mexico in 1846. In subsequent years, Valencia County was transferred from the 3rd to the 2nd Judicial District (1863), from the 2nd to the 7th Judicial District (1909), and from the 7th to the 13th Judicial District (1971). Upon statehood in 1912, the Territorial Courts became the New Mexico District Court.
